The legal battle between Min Hee-Jin and HYBE is heading into its next round, as the Seoul High Court has scheduled the first hearing of HYBE’s appeal for December 17 at 2:40 p.m.
According to a report by MyDaily’s Park Seo-yeon on October 16, citing legal sources, the appeals court has set the date for the first oral argument in the lawsuit over the termination of the shareholder agreement between the former ADOR CEO and HYBE.
HYBE had filed the suit seeking confirmation that its shareholder agreement with Min had been terminated. On February 12, the first-trial court — the 31st Civil Division of the Seoul Central District Court — dismissed HYBE’s claim in full, rejecting every ground for termination the company had raised. The court also ordered HYBE to bear all litigation costs.
HYBE appealed, moving the fight to the Seoul High Court.
In a related case, the same first-trial court ordered HYBE to pay Min approximately 25.5 billion won in Min’s put option lawsuit over stock purchase proceeds. The two appeals sit with different appellate divisions, and the put option appeal’s first hearing date has not yet been set.
Min’s side stated it would “faithfully participate in the upcoming appeal trial based on the objective facts and legal principles confirmed by the first-trial court.” No statement from HYBE was available at the time of publication.
With the December 17 date now set, the shareholder agreement dispute enters its substantive appellate phase.
